Mira or Independent Contractors?

Mira personnel are W-2 employees which means that Mira is responsible for all salaries, benefits, administrative costs, payroll related taxes and adherence to all state and federal employment regulations. This means that Mira assumes all the responsibilities, liabilities, and risks associated with employment.

Hiring an independent contractor can be a challenging task. The IRS has established 20 guidelines to help employers determine whether a worker should be treated as an employee or an independent contractor for tax purposes. The penalties for misclassifying a worker as an independent contractor can be substantial. If you classify an employee as an independent contractor and you have no reasonable basis for doing so, you may be held liable for current and past employment taxes for that worker.

Workers who believe they have been improperly classified as independent contractors by an employer can appeal to the IRS to collect the employee’s share of uncollected Social Security and Medicare taxes due on their compensation in addition to any benefits that are extended to employees.

Using Mira for your staffing needs also reduces your exposure to some types of lawsuits, such as those alleging job discrimination, wrongful termination or other grounds for liability. For instance when an employee is injured on the job, his or her only recourse is through the workers’ compensation system. An independent contractor, however, can bring a lawsuit alleging negligence, defective machinery or equipment.
